The mother is from the USA, the father from Scotland. The baby will be born aug. 2008.
The parents will not be getting married.
The father is willing to claim paternity.
Is there any form that can be filled out prior to the birth that will ensure dual citizenship?
any help will be greatly appreciated. thanks! Is a child born in the USA to one American citizen and one British parent a citizen of both countries?
US law will make the child a US citizen by right of birth (jus soli). To obtain a passport, both parents will have to submit and sign a passport application, with proof of the child's birth in the US. Here is that process:

As for UK citizenship, the child will be entitled through the father but the parents will have to request either proof of citizenship or a passport through the nearest UK embassy or consulate in the US: here is that process:

Nothing can be filed before the birth, but it is very helpful to read through the processes, obtain the necessary supporting documentation, and be ready to apply as soon as possible after the child is born.Is a child born in the USA to one American citizen and one British parent a citizen of both countries?
Child born to at least one British parent should be able to claim UK citizenship, regardless of where the child is born. All you need to do is to report the birth of the child to the UK Embassy (if born overseas).
People born in the US are US citizens, regardless of their parents' citizenship(s), unless the child is born to a foreign diplomat to the US with diplomatic imunity.

So your child should be able to claim both citizenships. My suggestion? Go to Canada to give birth to your child, that way your child will have TRIPLE citizenships. Hope my answer helps.
For the child to claim a British passport basically you need to get married.
If the mother is British then the child is automatically British. As it is the father that is British, the right to not automatic as you are not married.
Yes. Regardless on where the child was born, the child does have the right in inherit the citizenship of both parents. When applying for a passport, you just need to present the child's birth certificate and proof of the parent's citizenship at the time of the birth.
Yes, the baby would have dual citizenship. US citizenship would be automatic (be sure to get a birth certificate), not sure about UK.
where will the mother deliver her baby? birthplace is another factor for citizenship. yes, it is possible for a person to have dual citizenship
No...if the mother is a USA citizen and the child is delivered in the USA then the child is an American citizen...!
The USA may, upon application, provide for dual citizenship until the age of ';majority'; (not maturity) which is 21 years of age in the USA, if the paternal father rears the child in his own country and the paternal mother is in agreement...
Until the child is born, no forms can be processed. As well, immigration laws are in constant change and should be reviewed well in both countries even now, before the child is born...
I am a child of identical circumstances and chose to be an American at age 21 even tho I was raised for several years in Canada...
I have a close friend of similar circumstance whose dad raised him in Germany and he also chose to remain an American at the age of 21...
Even tho we both were raised many years in a different country, there was no needed paperwork for either of us at age 21 because we both were already American born...
I am sure updated immigration laws are available on the internet but you may have to be a lawyer to understand them...
Good luck...
I can't tell you about US law, but according to British law, anyone born with at least one british parent can claim british citizenship and have dual citizendship. But if the child is born outside the UK then the claim must be made within 3 years (last time I asked in a european country, maybe shorter for a non-eu country), at the local british consulate or high comission. Registering the birth and issuing a british passport is about enough.
