My 9 year old son has a passport that needs to be renewed because it is about to expire.His father (whom he hasn't seen in 5 years) refuses to sign the new application. His father also lives 1200 miles away. We have joint custody however so he is required to sign the passport application. I went to court was told by the judge I could have my order amended to allow me to be the sole signer. Two days later the court got a letter from the father wanting that order stayed until July so he could appear.In the meantime, thinking I was able to renew the passport I planned a trip with my son in April to the states. If you and your son are crossing into the US by land, only a birth certificate is required. If you go by air, you'll need a passport for him.

Since December 11, 2001, all children who travel need a passport.
You are now required to complete a separate application form for each child, since all travelling children need a passport, including newborns.
Why does my child need a passport?

The International Civil Aviation Organization (ICAO) has recommended a policy requiring every individual who travels by air to have his or her own travel document. This policy has been put in place to combat the traffic of millions of children around the world who are often sold into slavery, child prostitution or worse. It increases the protection of children by ensuring that they have a valid travel document with a photo and other identifying information.
How does this policy affect current valid passports?
If you are a parent who holds a valid Canadian passport that lists the name of your child, the passport will remain valid for you and your child until it expires.
However, there are 2 exceptions. When your child travels without you or when he or she reaches the age of 16, your child is required to have a separate passport.
Who may apply for a child's passport?
* One of the child's parents.
* The custodial parent in cases of separation or divorce.
* The legal guardian.
What form do I use to apply for a child who is turning 16 years of age?
To obtain a passport for your child before he or she reaches 16, the application form PPTC 046, Child passport application for Canadians under 16 years of age, should be completed in full and returned to a Passport Canada office, together with an original proof of Canadian citizenship, two photographs and the fee.
Will my child require a new passport once he or she reaches the age of 16 and still holds a valid passport?
No. The passport of a child who turns 16 years of age continues to be valid until it expires. A passport issued to a child is identical to a passport issued to an adult.
In the case of custody, separation or divorce
All legal documents that refer to custody, the mobility of, or access to the child must be provided. If a divorce has been granted, a copy of the divorce judgement or order must also be provided. Where a joint custody provision exists, either parent may apply, but both parents must sign the application.
Replacement passport for children
To ensure that the passport and the photo reflect the appearance of the child, the period of validity for a child's passport is determined by the age of the child.
Children who have been issued a passport in their first year of life (between birth and 364 days) are entitled to a one-time gratis replacement passport. This is in recognition of the rapid change in the features of children of this age. However, the applicant must submit:
* a new application completed in full and signed by an eligible guarantor,
* new photographs taken within one month of the date the request for the gratis replacement is received,
* an original proof of Canadian citizenship,
* custody documents, if applicable, and
* the original passport.
The maximum validity period of the replacement passport is three years from the date of issue of the original passport.
