My Husband's 2 1/2 year old son lives in texas (we live in Oklahoma)... if the court order says that they have to meet us half way to drop him off for visitation and they don't show up, then what happens?
Can they go to jail if the offense occures more than three times? What happens when a custodial parent doesn't show for visitation drop off?
Make sure you always have the legal visitation papers with you when you go to the designated drop off spot and keep track of everytime she is late and doesnt let you know, and doesn't show up. if she doesn't show up or call to let you know of being late, that is withholding visitation and she can be held in contempt of court and the judge could shose to throw her in jail. But you would have to file charges and take it back to court. just keep track of it everytime with video cameras, pictures and notes. Look into the OK and TX laws on tape recording coversations without the other parties permission. Some states, the other person doesn't have to know they are being taped..but some do.
Just one time can lead to jail time... but its all up the judge. What happens when a custodial parent doesn't show for visitation drop off?
They would be in contempt of court. As a rule, you don't go to jail for that. It would be more likely that the custody agreement would be modified, in favor of the parent who was respecting the court's original decisions %26amp; respecting the child's right to a respectful, peaceful relationship with both parents.
Make sure that that custody agreement doesn't call for 'flexibility' on the part of the parents, when arranging for transfers. If one parent is refusing to work with the other in a respectful way, that parent, too, could be found in contempt of court.
are they failing to drop off the child or pick him up? there is certainly something you can do if they are not dropping the child off, but i doubt you can do much if they fail to pick the child up...i'm not sure... i seriously doubt it would be jail though
You would have to take him back to court and it will be up to the judge what happens next. You will also have to file in the county of residence of the child.
They can be found in cometemt of court and pay fine and or jail but not like years just something to shake them up
You need to report to the court each time it happens
they dont show up.
thats what happens.
lol jk (:
i dont think he can go to jail, but you can call the cops :D
