My husband thinks he is an heir to his grandfathers property. I told him not unless his parent was deceased?

His Grandfather had 5 children and they are all still living so the property goes to the 5 living children. What is the Louisiana Law on succession, Does it even apply in this case because the property is adjudicated. Can the children get the property back? Or someone else that is not next of kin?My husband thinks he is an heir to his grandfathers property. I told him not unless his parent was deceased?
It would depend a great deal on what is in the decedent's will about who was to inherit what property. Usually, the property and money go to immediate descendants which are the children, then the children of those children would inherit the share that their parents inherited, if there is more than one sibling to each grandchild, which your husband is, then it would normally be split evenly in equal shares. Then on down the line.My husband thinks he is an heir to his grandfathers property. I told him not unless his parent was deceased?
the 5 living children get first dibs, only if the grandfather specifically put ur husband as an heir in his will then the natural flow of parent to child will insue, it could be in the will.. who knows, and his parents would get it before him , he would likely only ever see 1?5th or even 1/10th of the estate, thats if his parents decide to leave him any, its their money regardless of how anyone feels about it
he is an heir but not the first in line if you know what i mean. that is assuming someone leaves him something.
