What can you do if non custodial parent is lying about employment to avoid child support?

She has been working at the same place for years....the state put in for a garnishment for child support that she never pays and she starts telling them she is unemployed. Not true...she is definitely still working there....called her AT WORK today.What can you do if non custodial parent is lying about employment to avoid child support?
If the employer doesn't comply with the order, the court can hail the employer into court, hold the employer in contempt and make the employer pay it.What can you do if non custodial parent is lying about employment to avoid child support?
I would get a video camera, I would get a newspaper, and then I would head to her work. When I turn the camera on it will be outside her work place, look at the newspaper and make sure you do not turn off the video from here. Once you have her in the shot where it is obvious she works, I would call my local child support and ask them where they want you to send the evidence to. What is more is so many parents do this, she should be made to show proof of how she supports herself etc. By the way, a lot of mothers feel they should not have to pay child support, dealing with my stepsons mother and her beliefs of CS when it comes to her having to pay.
Been through this. All you can do is document everything you do, and bring the evidence to court. Then, not only will she have to pay you child support NOW, but will have to pay back child support too, so she is actually screwing herself. Do you have a lawyer? If so, I suggest you have him call her work and ask for her, the courts will take the lawyers word over yours due to credibility.
If a garnishment is in place, it goes to the employer, not the employee. If ';she'; works in payroll, let child support know. They can call and verify from human resources/payroll whether she works there or not and why the employer hasn't honored the garnishment.





If she is self-employed, that's another thing and good luck getting money from someone who is self-employed. Child support can take her to court for contempt or a work search.
not only will she have to pay back arrearages for back child support, she will have to pay on going.





Not paying child support is not only a State crime, but its a Federal crime now too. She can be charged with a federal crime.





If her employer isn't complying with the support order, they can get into alot of trouble. Failure to comply doesn't go well with the Judges.





See if an attorney or your Child Support Agency can get a copy of her income taxes she's filed last year. She's going to have to pay taxes on the money she earns. That will be the proof you need to show she is employed and lying about it. She's a dead beat that can't take of her kids.





Maybe a few days in jail will wise her up and be responsible for these kids. After all its not their fault.
